1. Offer to Purchase: The display of products on our website constitutes an invitation to do business. When you submit an order, you are making an offer to purchase the goods.
2. Order Acceptance: Acceptance of your order is confirmed only when we send you the “Order Ready for Collection” notification via email, confirming your payment has been received and the stock has been allocated.
3. Pricing Policy (Important): All prices displayed on the website are inclusive of VAT (where applicable). We are bound by the price listed at the time of purchase. Please ensure all prices are loaded correctly.

3. Payment and Processing

1. Accepted Payment Methods: We accept the following payment methods: Credit/Debit Card (Visa, MasterCard, etc.), EFT (Electronic Funds Transfer), and Cash on Collection.
2. Payment Processor: All online card payments are securely processed through Ikhoka. Liquid Magic (Pty) Ltd does not store your card details.
3. Risk of Loss (Payment): The risk of loss transfers to the customer once the funds reflect in our account for pre-paid orders.

4. Collection Policy (Click & Collect Only)

1. No Delivery Service: Liquid Magic does not offer any delivery or shipping service. All purchases must be collected by the customer or an authorised third party.
2. Collection Address: Collection is strictly from 3 Edward Street, Pietermaritzburg.
3. Proof of Collection: The collector must present the Order Number and a form of valid identification (ID, Driver’s License, or Passport) for verification.
4. Risk Transfer (Collection): The responsibility and risk for the products transfer to the customer the moment the products are signed for and leave our premises.

5. Refund and Return Policy

This is governed by our separate Refund and Return Policy, the terms of which are incorporated here by reference.

• Damaged Goods: We comply with the Consumer Protection Act (CPA) and will offer a refund, repair, or replacement for any product that is demonstrably damaged or defective upon collection.
• No Change of Mind Returns: Due to the nature of paint and consumables, we do not accept returns for change of mind, colour mistakes, or opened/used products.

6. Intellectual Property (IP)

The name, logo, content, and branding of Liquid Magic are the intellectual property of Liquid Magic (Pty) Ltd and are protected under South African law. No part of this website or the brand may be copied or used without prior written consent.

7. Dispute Resolution and Governing Law

1. Governing Law: This agreement is governed by the laws of the Republic of South Africa.
2. Jurisdiction: In the event of any dispute arising from these terms or your purchase, you consent to the exclusive jurisdiction of the appropriate Magistrates’ Court in the Pietermaritzburg area.
